Haiti – Elections : discover the main changes made to the electoral decree

Pétion-ville, July 4, 2026.- Within a few months of the next elections, the Council of Ministers signed and issued a decree amending several provisions of the electoral decree. The changes include the conditions for candidature, the deadlines for the process, campaign financing, electoral litigation, sanctions for fraud and the strengthening of transparency mechanisms. The stated objective is to adapt the legal framework to current realities and promote a more credible electoral process.

The Transitional Government formally adopted a series of amendments to the Electoral Decree with a view to organizing the elections of 2026. These adjustments occur in a context where the authorities seek to restore the confidence of the population and political actors in the electoral process.

Among the main innovations are the revision of certain eligibility conditions for candidates, clarification of registration procedures, and updating of deadlines for the submission of applications and the handling of disputes. The text also clarifies the responsibilities of political parties, independent candidates and electoral authorities.

The decree also strengthens the mechanisms for monitoring the financing of electoral campaigns. Applicants will have to comply with stricter rules on reporting of expenditure and sources of funding in order to promote greater transparency and reduce the risk of irregularities.

Another important point was the review of the provisions on electoral offences and sanctions. The new law provides for a more rigorous framework for acts of fraud, corruption, intimidation of voters and any other practice that could jeopardize the sincerity of the vote.

The procedures for resolving electoral disputes have also been adjusted to speed up the processing of appeals and to ensure greater legal certainty throughout the process.

These changes are part of the preparations for the elections expected in 2026. They will now have to be implemented by the Provisional Electoral Council, with the support of relevant institutions, political parties and civil society organizations. Their implementation will be particularly observed, while many Haitians hope for inclusive, transparent and credible elections that can contribute to the return to constitutional order.
